Teignbridge District Council invites tenders from parties interested in entering into a 1 year licence for the operation of a sauna business. The Tender form is in the 'Additional Links' tab below.

Location
Teignmouth is a popular coastal resort and seaside town situated between Torbay and Exmouth. The pitch occupies an enviable seafront location adjacent Teignmouth beach situated on the Promenade benefitting from a high seasonal footfall. Some of the nearby attractions include the Pier, the adventure golf, children’s playground and skate park.

Description
The Council invites rental offers from interested parties to operate from this site. The opportunity consists of the right to use the trading pitch for the placement of a sauna owned by the Licensee. The pitch dimensions are approximately 4m (at its widest part) x 13m (overall allowing for the curve the pitch is approximately 30 sqm).

For the avoidance of doubt, the operator will be required to provide their own unit to operate from together with their own equipment.

General Terms
1. The Licensee shall be permitted access to the pitch across Council owned land on a daily basis, for the purposes of moving the equipment, restocking, servicing and removal of waste. Please note however that due to the restricted vehicular access in this pedestrianised thoroughfare, movements to and from the site will be restricted to early mornings and evenings only.

2. The Licensee must comply with the Council’s Bye-Laws and Regulations for the time being in force which must not be infringed. Touting for business is prohibited by the Council’s Byelaws.

3. The Licensee shall be responsible for maintaining the site in a clean and tidy condition and for providing for the regular clearance of all litter and refuse from the immediate vicinity of the site with the provision of suitable refuse receptacles and be responsible for the removal of such receptacles and the litter therein at the end of each day’s trading.

5. The Licencee shall indemnify and keep indemnified the Council from all liability in respect of loss, damage, actions, proceedings, suits, claims, demands, costs, damages, liability and expenses in respect of any damage or injury to any person or property by reason of or arising in any way directly or indirectly from the Lessee’s use of the site, and take out and maintain third party insurance for all loss or damage however caused.

6. There is no provision for waste water disposal from the site and the Lessee must make suitable arrangements in this respect. Discharges of waste on to the Promenade will not be permitted.

7. The Licencee shall not be permitted to assign, sublet or in any way transfer the benefit of the Lease.

8. The Licencee must not make any amendments or alterations to the site, and the Lessee shall repair and make good any damage to the site caused as a result of its use or occupation of the site.

Planning
The Licencee shall be responsible for obtaining any necessary planning consent or other statutory approval which may at any time become necessary for the operation of the business at The Den Teignmouth.

The tenderer is encouraged to make enquiries with Teignbridge District Council’s Planning Department to ascertain whether or not planning consent will be necessary.

Tenders
Interested parties are invited to submit offers for a Licence by way of a sealed informal tender by 2pm on Tuesday 11th June 2024, using the attached Expression of Interest Form. The Offer should, as a minimum, include:

Completed tender form;
Your proposal for the type and style of concession proposed;
Photographs of the proposed unit to be used to trade from;
A brief business plan, including your rental offer, details of any market research undertaken, previous business experience, details of the sports equipment to be offered for hire and costings;
Trade or other references;
Confirmation that all staff to be employed by the Licencee have been dbs screened or will be prior to being employed.

Parking
There is no dedicated parking with the pitch. It should also be noted that the Upper Den Carriageway is an adopted highway and is closed for the period May-September in each year. There is off-street parking available (on the Den) and the Point car park is located some 280 metres away. Use of any public car park will be in accordance with the local terms and conditions of the car park.

Insurance
The Lessee shall maintain a Public Liability Indemnity insurance policy to the value of not less than £10,000,000 for any one claim. The Council reserves the right to vary this figure from time to time as and when deemed necessary.

Services
There are no services including mains electricity connected to the site.

Business Rates
The trading site offered is not currently subject to a rating assessment. At such time as the use of the site commences, it will be assessed for rating purposes and the Lessee would be responsible for any rates payable and all other outgoings relating to their use of the trading site.
