SITUATION

The property is situated within 100 yards of the A381 Kingsbridge to Totnes road, Kingsbridge being about 5 miles away and Totnes some 7 miles distant. The A38 dual carriageway expressway is only a further 4 miles or so from Totnes.

BUILDING AND YARD
A copy of the planning consent for the building together with the section 106 agreement (stating
that the access road must be kept clear at all times) is avaiable for inspection at the agent's office at 62 Fore Street, Kingsbridge, TQ7 1PP.

The whole site extends to approximately 0.50 acres as approximately shown on the site plan. In the event that the building, yard and adjoining agricultural land do not sell as one lot (see method of sale below) the seller will undertake to erect a stockproof fence between points E and G.

WAYLEAVES
The land is sold subject to all existing Wayleaves and Wayleave Agreements in respect of electricity, water, drainage, telephone, pylons, poles, stays, wire, pipes, etc, if any.

RIGHTS EASEMENTS COVENANTS
The land is sold and will be conveyed subject to the burden of all easements, public and private rights of way and other rights and privileges and liabilities affecting the land or any part thereof. The Vendor shall not be called upon to define the same except as hereinafter.

METHOD OF SALE
Higher Chilley is being offered for sale by Public Auction on 20 November 2008 at 3.00 pm at The White Hart Inn, Modbury PL21 0QW subject to Luscombe Maye's General Conditions of Sale (copy available on request) and the Special Conditions of Sale relating to the property (see below).
 
The building, yard and agricultural land shall be offered for sale as a whole initially (Lot 1). In the
event this does not sell then only the building and yard shall be offered for sale (Lot 2). The adjoining 3.45 acres of agricultural land will not be offered for sale as a separate lot.

ORDER OF SALE
The Vendor reserves the right to sell the property at any time prior to the Auction, to withdraw from the sale, to alter the boundaries of the land or to divide into further Lots and to alter the order of sale.
